Medical Question- Please check to see if my answer is right.?
A. There's an implied contract with the tolerant
B. There's an express contract with the tolerant
C. The surgery is cosmetic
D. The surgery is medically necessary
(I chew over it is either C or D..please assist!)

I'm a paralegal with several years of healthcare experience -- I love contract ruling (which is what this is).
If a doctor directly tells a tolerant that a surgery WILL create a particular result, the it's an expressed contract near the patient IF adjectives of the elements of a contract are met.
It's either A or B. There is zilch in near that says whether the surgery is cosmetic or medically vital. What it is talking give or take a few is the warranted result, which routine there is a contract between the doctor and the forgiving that the patient will salary the money for the surgery in anticipation of getting the result the surgeon promised. Like, paying to enjoy a nose livelihood that's supposed to end up looking approaching Diana Ross, and ending up beside a nose that looks similar to Jimmy Duranty. I'm just not sure if it is express or implied.
